Foxwoods Labor Peace Viable Recent labor settlement shows path to a union contract exists.
By The Day         Published on 3/26/2008

The recent settlement of labor complaints demonstrates that the Mashantucket Pequot Tribal Nation and unions can resolve differences without diminishing tribal sovereignty. Thirty-five claims of unfair labor practices filed against the tribe-owned Foxwoods Resort Casino were resolved under a settlement agreement between the casino, United Auto Workers and the National Labor Relations Board (NLRB).
Casino employees had claimed they were harassed or retaliated against because of their union-organizing efforts. Table game and poker dealers voted nearly four months ago to organize as a UAW union. The vote was decisive — 1,289-852. Efforts by the casino to overturn the vote on appeal have so far failed. The primary issue for the tribe is sovereignty. It contends that the National Labor Relations Act does not apply to the tribe and that tribal labor law must govern any union organizing. But the recent announcement shows there is a middle ground. The tribe willingly entered into negotiations that included the NLRB, while never conceding it was bound by the federal labor act. The tribe could follow the same path in negotiating a contract with the new UAW union. In the interest of labor peace, the tribe could voluntarily negotiate a contract that adheres to the federal labor act, while taking the position it does not have to do so because of its sovereign standing.
So far the casino has pursued a strategy typical of many large businesses. It has fought the union at every point in the process, placing the pressure on the union to keep its members unified as the process drags on. But this is not a typical situation. Foxwoods is opening a major expansion and facing increased competition. A frustrated work force that concludes management is stalling could result in morale problems that diminish customer service at this critical time. And if the tribe presses the issue all the way to the U.S. Supreme Court it risks an adverse decision that could erode sovereignty in ways the tribe did not envision. No one wins if this union fight continues to drag on. The recent settlement of the labor complaints suggests that it doesn't have to happen.

GREAT NEWS!
Bally's Election is Certified NLRB Rejects Management Objections
The National Labor Relations Board issued a decision rejecting Bally's management's appeal of our June 2007 union representation election.
That means our Union will be certified and Bally's will be legally obligated to bargain with us!
We voted by an overwhelming majority to form our own union as part of the UAW. Bally's management appealed the results of our election as a stalling tactic. It shouldn't have taken this long to get to the bargaining table but we've stood together. Now it's time to negotiate a fair contract!
This is an exciting and historic time in Atlantic City. We are part of a change that will provide a powerful and lasting voice for dealers across Atlantic City. Together we have the power to do what we cannot do alone. Through collective bargaining we can achieve what matters to us most -- fairness, respect and security.
