UAW Tropicana October 29. 2007 - Negotiations Update
On behalf of the International Union, we want to thank you for the talented and dedicated Bargaining Team you elected. It was clearly evident the first time we all met that with their knowledge and skill and with the overwhelming support of membership collectively we are a force to deal with in our fight to win a fair contract.
     We have submitted a formal request to management for basic employment information we will need in order to begin to formulate our contract proposals. To date management has not responded. We remain hopeful that the information will be provided shortly. In the interim, your Bargaining Team has been meeting, on their own time, to clarify the issues and discuss strategies. The response to the bargaining surveys was impressive. The Bargaining Team has reviewed every single response. We will continue to meet as a team to ensure we are ready to hit the ground running once we receive the necessary information to prepare for and begin bargaining.
     As you know, the Tropicana Slot Technicians voted to join our UAW ranks on October 22, 2007. Collectively, this makes all of us even stronger. Congratulations to our Brother and Sister Slot Technicians for standing up to demand a voice in their workplace. You have our full support.
     While in the process of formulating our proposals, we are forming some of our standing committees that will serve the membership and provide resources to your bargaining team.      As most of you know, William Yung and his Columbia Sussex Corporation were denied their license by the Casino Control Commission today. This follows months of legal proceedings. The Commission has appointed a trustee to oversee operations until a new buyer can be found. The Union's attorneys are researching the issues. We will keep you updated as we find out more details. Below is the press release from the Casino Control Commission:
     ATLANTIC CITY - The Casino Control Commission today refused to renew the casino license of the Tropicana Casino Hotel Wednesday and turned over control of the property to a trustee.
     By a 4-1 vote the commission ruled that the Tropicana's owners, Tropicana Casinos
and Resorts, failed to meet strict state licensing requirements, including a lack of
business ability, a lack of financial responsibility and a lack of good character
honesty and integrity.   
     In making the decision, the commission said that Tropicana's regulatory compliance since it was acquired by Tropicana Casinos and Resorts in January "has been abysmal."
     As a result of the vote, the commission activated a pre-existing trust to take control of the property away from Tropicana Casinos and Resorts. A year aeo, as part of that firm s request for interim casino authorization, the commission approved the selection of former New Jersey State Supreme Court Justice Gary Stein as the trustee Commission Chair Linda M. Kassekert noted that the casino will remain open and operating under Stein's direction.
     "This in no way interrupts casino operations," she stressed. "The casino and the hotel remain open. The employees will be on the job and will be paid and customers will be able to gamble and enjoy all of the amenities that the Tropicana has to offer."
     This is only the second time that the Casino Control Commission has refused to renew a license.   In 1989, the commission denied a renewal for Elsmore's Atlantis Casino Hotel. That case was the result of financial problems at the Atlantis
     The commission Wednesday pointed to a series of business decisions that seriously hurt the property and a series of executive changes that raised questions about the company's ability to make the choices necessary to maintain a competent management team.
     "In some respects, this has been the most difficult of cases because the Commission has had to apply its institutional regulatory expertise derived over the life of this agency to tell a long-time and otherwise apparently successful businessman that he lacks business ability," Kassekert said.
     "In other respects, the decision has not proven to be difficult at all, given the applicants' demonstrated ineptness at appreciating the workings of the Atlantic City casino marketplace. The applicants could have taken the time to educate themselves in what it takes to operate successfully here, or they could have hired and retained sufficient staff knowledgeable in those processes. They have done neither, and must bear the consequence," she added.
     She added that William Yung III, the owner of Tropicana Casinos and Resorts "exhibited a lack of cooperation on a grand scale that did nothing to earn regulatory trust in his ability to operate in this marketplace. Moreover, his decision-making process was seriously flawed.
     Commissioner Michael A. Fedorko was the sole member who voted against the denial of the license renewal.
     "A recommendation to deny licensure proposes an extraordinary result, which 1 believe goes far beyond what is called for in this case," Fedorko said.
Kassekert said that the commission immediately beefed up its presence in the Tropicana with additional inspectors and representatives from the commission's compliance, licensing and financial evaluation divisions. She said she anticipates the trustee will be on hand starting Thursday to oversee ongoing operations.

MARCH 20, 2008 - NEGOTIATIONS UPDATE
When we met with the Company last week we made some progress as we came to agreement on the Recognition Clause. In addition we exchanged proposals on a No Strike/No Lockout clause, Union Security and Grievance Procedure proposals. Management refused to provide us with information relative to the sale of the Tropicana and would not share information with your representatives that they openly shared with the Atlantic City Press!
When we met with the Company today at the Atlantic City Sheraton we presented the company with counter proposals for the grievance procedure and Union Security. Unfortunately the Company showed very little movement and took some unreasonable positions. We expect management to live up to the commitments made by the conservator, Justice Stein, to make significant progress.
Management has confirmed three more dates for bargaining, March 27, April 15 and April 24. We open negotiations with Management for the Slot Technicians on April 17 and April 23. United we will fight to get a fair contract for both Bargaining Units.
We will continue to work to resolve issues that from time to time come up in the workplace or when management acts illegally. We have put Tropicana on notice that all changes in terms and conditions of employment and discipline must be bargained with the Union before implementation. UAW Tropicana February 20.2008 - Negotiations Update
Since our last update we have met with the Company on two occasions, January 29 and February 18, 2008. At the first meeting the Union presented a proposal for ground rules and presented management with several Union proposals for contract language.
At our second meeting we had further discussions on bargaining ground rules which still remain unsettled, however we have agreed to the majority of the rules. At this meeting we successfully bargained our first agreement on one of the Union's proposals on basic contract language. Every journey starts with a first step and with your continued support we are confident this will be the first of many successes at the bargaining table.
Management has confirmed four more dates for bargaining, February 28, March 12, 20 and 27.
The search for a new owner has fallen behind the timeline originally provided to us by the Trustee, Justice Gary Stein. We have requested an up to date timeline of the process. We have also requested copies of the documents to be provided to prospective bidders.
We will continue to work to resolve issues that from time to time come up in the workplace or when management acts illegally. We have put Tropicana on notice that all changes in terms and conditions of employment and discipline must be bargained with the Union before implementation.
