SUBJECT:      UAW Caesars 8-9-2007 Negotiations Update

     As you know, August 9, 2007 was our first face to face negotiations meeting with your employer. As will always be the case, your seven-member elected bargaining committee attended this historic meeting. The expression on the face of each of your fellow workers clearly conveyed the evident satisfaction they enjoyed when realizing they were across the table from their employer who now has the legal obligation to bargain over your terms and conditions of employment.
     The Company was represented by Richard Tartaglio (Director, Labor Relations), Pat Lineran (Labor Relations), Frank Muscolina (Vice President, Caesars Human Resources), Mike Welsh (Vice President of Development), Attorney Richard Appel and Chief Spokesperson, Attorney Lawrence Levien. Attorneys Appel and Levien are from the Washington, DC, based firm Akin, Gump, Strauss, Hauer & Feld. Interestingly, Vice President and Associate General Counsel, Gerald A. Einsohn surprisingly withdrew from the negotiations and immediately left the meeting.
     During this meeting the Company and the Union negotiated and agreed upon preliminary ground rules dealing with the conduct of negotiations. The Company and the Union also negotiated and agreed to designate September 5, 2007 at 1:00 p.m. as the next negotiations date We also agreed to change for now, the location of the negotiations to the Fairfield Marriott Hotel in Absecon and to equally share the costs of the meeting room and beverages. Additionally, we raised strong objections to the company's lack of availability for negotiations and we announced that our availability would continue to be on a seven (7) day per week twenty-four (24) hour per day basis.
     We also raised the issue of the company changing your terms and conditions of employment as it relates to the employer requiring you to attend "Responsible Gambling Training" during your breaks. Today we received a written communication from Richard Tartaglio who stated that "training on break time has ceased." Please see the attached memo. We also raised the unresolved Letter of Agreement that was derived from the Company and Union's interim agreement reached on 5-9-07 paving the way for prescription availability at the Wellness Center/Pharmacy. As of today, the company has failed to sign a document that accurately reflects the parties' agreement. However, they have provided an employer signed document that would take away the union's right to bargain over termination of the agreement. WE DON'T THINK SO! The Company's chief spokesperson assured us that he would review the facts and respond to this issue on 9-5-07.
     Finally, during this meeting we presented the following proposals to the employer on your behalf:

•    Notification Language
»    Grievance Procedure Language
•    Seniority Language
•    Hours of Work (including Early Outs, Starting Times, Schedules and so on)
Language
•    Leave of Absence Language

The Company said they would review these proposals prior to our 9-5-07 meeting and they would come to that meeting prepared to ask questions and have discussions regarding these proposals.

UAW Caesars September 5, 2007 - Negotiations Update

     In attendance for the Company: Attorney Lawrence Levien, Attorney Richard Appel, Richard Tartaglio, Pat Fineran, Frank Muscolina, and Mike Walsh.

    We conducted our second session of negotiations with your employer on September 5, 2007 at the Marriott Hotel in Absecon.   We submitted on your behalf a comprehensive Non-Economic Proposal to include all your issues for negotiations. Mr. Joseph Cleary from the Law Firm of Cleary and Josem, LLP attended the negotiations as counsel for the UAW. Mr. Cleary has been representing union workers in Atlantic City for many years and is an asset to our negotiating committee.

     Our Non-Economic Proposals given to the Company on 9-5-2007 were: Preamble, Recognition, Union Shop & VCAP Check-Off, Representation, Notification, Grievance Procedure, Seniority, Hours of Work, Leaves of Absence, Call-Outs/Absentee Program, Overtime, Bereavement & Jury Duty, Discipline & Discharge, Bargaining Unit Work, No Discrimination, Tokes, Uniforms/Appearance, Cafeteria/Vending/Lockers/Lounges/Restrooms, Adverse Weather, Wages, Vacations, Holidays, Health Care, Health & Safety, Miscellaneous, Strikes and Lockouts, Approval of Agreement, Defined Pension, Successor Clause, Separability./Company Rule Conflict, Posting Contract, EAP Program and Duration.

     We blocked out all economic portions for later negotiations. We made proposals that include no smoking where UAW members work. We made proposals to ensure no loss of jobs due to electronic virtual reality games.

     The Company asked for clarification on our proposals submitted to them on August 9, 2007. The Union clarified our proposals and will be amending some proposals for more clarity.

     The Company also agreed to bargain any changes to the Wellness Center Prescription Drug Plan currently in place. Previously, they took the position that if they changed it for everyone else then they would change it for you without bargaining with us. We are very pleased to resolve this issue and will reduce to writing in our next session.

     The Company will review our entire package submitted on 9-5-2007 and respond. We will submit amended proposals on your behalf at our next meeting on September 18, 2007.

     That is all we have to report for now. Our next communication to you will be distributed following our September 18th meeting.

SUBJECT    UAW/Caesars Negotiations Update - September 18, 2007

     Based on our previous discussions at our September 5, 2007 negotiations session, we provided the Company with a modified proposal on Seniority and Call Outs on September 18, 2007.
    The Company raised several issues which they have major concerns over with regard to our proposals. First of all, they raised the issue of Moonlighting based on our current proposal to eliminate this policy. You may not be aware of the fact that the Harrah's Handbook prohibits employees from working at other houses in the same job. You are well aware that during many organizing campaigns the casinos have stated the UAW policy would not allow you to work in two (2) different houses if you are a UAW member. The UAW has stated clearly that this is not true and we put letters out and full page newspaper ads addressing this issue assuring our members and our potential members that the UAW would allow members to work at other houses without any restrictions. Our current proposal is to eliminate the Handbook Policy on Moonlighting and allow our members to work in more than one (1) house at whatever job they choose.
     The Company also raised objection and concern on our proposal that would eliminate jobs through new technology like Virtual Reality Dealers. The purpose of this proposal is not to stop the Company from becoming more competitive but rather to insure our members never lose their jobs due to technology improvements or advancements. This proposal is a major issue for the Union to preserve your jobs throughout all the Atlantic City Casinos.
In closing, we have been encouraged by our discussions at these negotiations. The Company is thoroughly reviewing our proposals and asking questions about our proposals. We will continue to work towards an agreement that we can all be proud of and advance your issues of concern. Our next negotiation session will be on October 2, 2007.
     This is all we have to report for now. Our next report will be sent following our October 2nd meeting.

UAW/ CAESARS NEGOTIATIONS UPDATE OCTOBER 2,2007

     We conducted our fourth (4th) negotiating session with Caesars on October 2, 2007 at the Sheraton Hotel in Atlantic City.

In Attendance for the Union: Tom Brady, Sharon Masino, John Lockard, James Zarrello, Amelia Rivera, Kathleen Bresan, Bob Pike & Terry Dittes

In Attendance for the Company: Larry Levien, Richard Appel, Richard Tartaglio, Pat Fineran & Frank Muscolina 

      The Union provided an amended proposal on Hours of Work to the Company. The Company had some questions on our previous proposals on Hours of Work so we amended and clarified our proposal. The previous questions were answered during clarification and the company fully understood our proposal and had no further questions on this Article or any of the Articles we previously submitted on your behalf.
     The Company proposed agreeing to common definitions so that they could provide a comprehensive proposal like the Union did on September 5, 2007. We addressed these common definitions for the purpose of getting closer to a contract with the employer. At the conclusion of resolving these common definitions we are pleased to report the Company will provide a comprehensive non-economic proposal to us at our next bargaining session. We see this as a major step to moving forward to getting a contract for our members and their families.
     We asked for clarification on the new practice of an application for part-timers becoming full-timers. As you are aware our proposals ask that current part-timers who want to be full-time have an opportunity to become full-time by the contract. We also proposed that the Company employ a large percentage of full timers at Caesars so full-time jobs are not eroded while keeping all part-timers who wish to remain part-time. The Company will provide information on this new practice before or at our next session.
     We also raised the issue of VTO time and PTO time. We informed the Company that our members are being told the Union is stopping them from getting VTO and PTO time off by their supervisors. We also brought up the unfair scheduling practices and that dealers are not being allowed to switch games like in the past. Supervisors are telling our members it is because of the Union that no switches can take place. The Company will respond to us on those subjects brought to their attention before or at our next bargaining session.
     Despite the fact that Supervisors are blaming the Union for any negative changes at the Casino, we are encouraged by our progress. We will have a complete comprehensive proposal from the Company at our next session and hope to make progress on your important issues. The tactics by Supervisors verbalizing false statements about the Union during organizing drives or contract negotiations are of no surprise to the UAW. Regardless of this tactic we will push forward to bring you a contract for you and your family.
     Our next session will be held on October 22, 2007. We will update you on our progress shortly after that Bargaining Session.

November 6. 2007
     In attendance for the Union: Tom Brady, Sharon Masino, John Lockard, James Zarrello, Kathleen Bresan, Amelia Rivera, Kim Blake, Terry Dittes, Bob Pike & Joe Sinni.
     In Attendance for the Company: Larry Levien, Richard Appel, Richard Tartaglio, Pat Fineran, Frank Muscolina, and Mike Walsh.
     At our November 6, 2007 negotiating session both parties agreed to suspend main table negotiations in order to discuss Interim Health Care. The Union requested relevant information at this meeting regarding the proposed health care changes for 2008. Additional information was requested in writing subsequent to this meeting by the Union.
November 19. 2007
     In attendance for the Union: Tom Brady, Sharon Masino, John Lockard, James Zarrello, Kathleen Bresan, Amelia Rivera, Kim Blake, Terry Dittes, Bob Pike & Joe Sinni.
     In Attendance for the Company: Richard Appel, Richard Tartaglio, Pat Fineran, Frank Muscolina, and Jeff Shovlin.
    When we met on November 19, 2007 we had gathered additional Health Care information that was used to formulate proposals on your behalf. We submitted verbal proposals to the Company at this meeting on the newly proposed HMD Plan for 2008. At the conclusion of this session, agreement was reached on the proposed Company changes for 2008 to ensure all our members would retain health care in 2008. November 19, 2007 was the deadline to have a plan in place to insure your health care would not be interrupted. As a part of the agreement and settlement, we agreed to continue bargaining over Interim Health Care up to February 1, 2008. We agreed any changes to the proposed health care made during this process would become effective within 45 days of such agreement. We also agreed another open enrollment would take place if any new changes were bargained. This agreement was reached on behalf of the Dealers Bargaining Unit and Slot Technicians. Additionally, another Open Enrollment will occur shortly for you to choose your health care plan effective 1/1/2008.
November 20. 2007

     In Attendance for the Company: Richard Appel, Richard Tartaglio, Pat Fineran, and Frank Muscolina.
     The Union and Company agreed to continue Interim Bargaining on 2008 Health Care and conducted no main table negotiations for a Labor Agreement. The Union made a proposal for the current Cigna Health Care plan and the Company said they would respond. We have scheduled main table negotiations to resume at our next session on December 7, 2007.
We have no more to report at this time, but will report after our next negotiating session.
